Open Row Holdings, LLC, doing business as Open Row Market ("Open Row," "we," "us," or "our"), respects the privacy of growers, vineyards, wineries, buyers, agricultural businesses, industry participants, and website visitors. This Privacy Policy explains how we collect, use, disclose, retain, and protect information through www.openrowmarket.ag">OpenRowMarket.ag, our onboarding activities, and our related agricultural information, discovery, communication, and introduction services (collectively, the "Services").
Open Row is currently an agricultural technology, information, onboarding, discovery, and communications platform. We do not currently operate a publicly searchable grower marketplace or public user accounts, process agricultural purchase payments, or act as the contractual buyer or seller in transactions between industry participants.
By using the website, submitting information to Open Row, or otherwise interacting with the Services, you acknowledge the practices described in this Privacy Policy.

1. Information We Collect
The information we collect depends on how you interact with Open Row and the information you choose to provide.
Contact and business information
- name;
- company, farm, vineyard, winery, or organization;
- title or professional role;
- email address;
- telephone number;
- mailing or business address;
- professional affiliations; and
- other contact or business information you voluntarily provide.
Agricultural, vineyard, crop, and property information
- farm or vineyard name;
- vineyard or agricultural property location;
- AVA or other geographic information;
- acreage and vineyard blocks;
- varieties, clones, rootstocks, planting information, vine spacing, and vine counts;
- estimated yields, production history, and available tonnage;
- crop condition, harvest timing, Brix, chemistry, or other analytical information voluntarily provided;
- farming practices, irrigation information, and certifications;
- sustainability, organic, regenerative, biodynamic, or related information;
- asking prices or other pricing information voluntarily supplied;
- agricultural or property history;
- photographs and property characteristics; and
- other agricultural information voluntarily submitted.
Buyer, winery, and industry-participant information
- company and contact information;
- commodities or varieties sought;
- desired tonnage;
- geographic preferences;
- pricing or budget information voluntarily supplied;
- quality, production, or processing requirements;

Agricultural or business information does not necessarily constitute personal information. However, such information may be personal information when it identifies, relates to, describes, or can reasonably be associated with an identifiable individual.
2. Website and Technical Information
When you visit www.openrowmarket.ag">OpenRowMarket.ag, our website infrastructure may collect technical and usage information automatically. This may include:
- IP address;
- browser, network, and device information;
- operating system;
- pages visited and referring webpages;
- clicks, internal links, scrolling, searches, and other site interactions;

Our website is hosted by Squarespace. We currently use Squarespace Analytics to understand site traffic and activity. Squarespace may process technical and usage information on our behalf in order to host, secure, deliver, and analyze the website.

- through Open Row website forms;
- through email, telephone, and text communications;
- during onboarding discussions, meetings, or vineyard visits;
- through spreadsheets, documents, photographs, or other materials you provide;
- from persons authorized to provide information concerning an agricultural property or business;
- from publicly available sources or lawful industry sources; and
- automatically through our website and its underlying technology.

We may use information to:
- onboard growers, vineyards, agricultural properties, wineries, buyers, and other industry participants;
- create and maintain agricultural, property, crop, availability, demand, and industry profiles;
- organize, normalize, categorize, and summarize agricultural information;
- maintain crop and availability information;
- understand buyer needs and commercial interests;
- identify potentially relevant relationships or opportunities;
- facilitate discovery and make introductions between appropriate industry participants;
- confirm, clarify, correct, or update submitted information;
- respond to questions and inquiries;
- maintain agricultural and business relationship records;
- operate, secure, troubleshoot, and improve the website and Services;
- understand website traffic and use;
- develop and improve Open Row technology;
- comply with applicable legal obligations;
- prevent fraud, misuse, or security incidents;
- establish, exercise, or defend legal rights; and
- carry out other purposes reasonably related to the reason the information was provided.
Open Row does not treat the submission of agricultural information as authorization to negotiate a commodity transaction on behalf of a grower, buyer, winery, or other participant.
5. Agricultural Information, Ownership, and Nonpublic Profiles
As between Open Row and the person providing agricultural information, growers and other submitting parties retain ownership of their underlying proprietary agricultural information.
Providing information to Open Row permits us to process, store, organize, normalize, categorize, summarize, maintain, and communicate that information as reasonably necessary to provide the Services and accomplish the purposes for which the information was submitted. This Privacy Policy does not transfer ownership of a grower's underlying farm, vineyard, crop, or proprietary business information to Open Row.
Open Row does not currently operate a publicly searchable database of grower, vineyard, crop, buyer-need, or availability profiles. Information submitted for industry discovery may be selectively communicated to appropriate prospective buyers, wineries, growers, processors, or other legitimate agricultural industry participants when reasonably relevant to the purpose for which the information was provided.
Open Row may separately own its platform architecture, database structures, classifications, workflows, software, technology, interfaces, organization, and deidentified or aggregated information developed through operation of the platform, subject to applicable law and any separate written agreement.
6. Discovery Information and Confidential Information
Information provided to Open Row may be handled differently depending on its purpose:
- Discovery information: information provided for the purpose of identifying potential commercial relationships or opportunities. Appropriate portions may be communicated to relevant industry participants.
- Internal onboarding and relationship information: information used by Open Row to understand a participant, property, opportunity, or relationship and administer the Services. It is not necessarily shared as part of discovery.
- Confidential information: information that Open Row has expressly agreed in writing to treat as confidential, including where a separate confidentiality or nondisclosure agreement applies.
- Publicly available information: information Open Row may independently collect and use where legally permitted.
Simply marking information as "confidential" does not by itself create a separate nondisclosure agreement or guarantee absolute confidentiality. If you do not want particular information communicated to prospective industry participants, tell Open Row before submitting it for discovery purposes.
7. How We Disclose Information
We may disclose information to the following categories of recipients when reasonably necessary for the purposes described in this Policy:
Agricultural industry participants
We may communicate appropriate discovery information to prospective growers, buyers, wineries, processors, agricultural businesses, and other relevant industry participants for discovery, communications, and potential introductions.
Service providers
We may use vendors and service providers to help operate our business and Services, including website hosting, cloud infrastructure, data storage, email, communications, analytics, security, business software, and professional services. Squarespace currently provides website-hosting, analytics, and related website infrastructure for www.openrowmarket.ag">OpenRowMarket.ag.
Professional advisers and corporate counterparties
We may disclose information to attorneys, accountants, consultants, insurers, financing sources, investors, and other professional advisers, as well as to parties involved in legitimate financing, investment, due diligence, merger, acquisition, reorganization, sale of assets, or similar corporate transactions, subject to applicable law and appropriate confidentiality protections.
Legal and safety purposes
We may disclose information when reasonably necessary to comply with law or lawful governmental requests, protect legal rights, investigate suspected fraud or unlawful conduct, protect Open Row or others, maintain the security and integrity of the Services, enforce agreements, or address legal disputes.
8. Cookies and Squarespace Analytics
www.openrowmarket.ag">OpenRowMarket.ag uses cookies and similar technologies. Necessary cookies are used to allow Squarespace, our hosting platform, to securely operate and deliver the website.
We also use Squarespace Analytics to understand website traffic and activity. Squarespace Analytics may process information such as browser, network, and device information, IP address, referring webpages, pages visited, clicks, internal links, scrolling, searches, timestamps, and similar information about how visitors interact with the website.
Our website displays a cookie banner. Non-essential analytics and performance cookies are restricted until you make a choice through the banner. You may accept, decline, or manage non-essential cookies using the controls provided through the website. Necessary cookies required for the website to function cannot be disabled through those controls.
You can also manage cookies through your browser settings. Disabling or declining certain cookies may affect website functionality or the completeness of analytics information.
Open Row does not currently use Meta Pixel. If we add material third-party analytics, advertising, or tracking technologies in the future, we may update this Privacy Policy and our consent controls as appropriate.
9. Do Not Track and Privacy Preference Signals
Some browsers and devices transmit "Do Not Track" or privacy preference signals. There is no single universally adopted standard for legacy Do Not Track signals. Our cookie banner is the primary method for managing non-essential cookies on www.openrowmarket.ag">OpenRowMarket.ag.
Where applicable law requires Open Row to recognize a legally qualifying opt-out preference signal, including a qualifying Global Privacy Control signal, we will process that signal as required by applicable law.
10. Phone, Text, and Email Communications
When you provide contact information to Open Row, we may use it to communicate with you regarding onboarding, crop or product availability, profile updates, submitted information, buyer or seller inquiries, potential opportunities, introductions, administrative matters, and other service-related communications.
Where an Open Row form or communication provides an authorization to contact you by telephone, text message, or email, we may communicate with you for the purposes described in that authorization. Providing contact information for operational or service-related communications does not constitute unrestricted consent to receive marketing communications.
Where applicable law requires additional consent for automated, promotional, or marketing communications, Open Row will seek that consent before using the applicable communication method. You may ask Open Row to stop nonessential communications by contacting micah@openrowmarket.ag. Reasonable opt-out requests will be honored where applicable.
11. Artificial Intelligence and Automated Technology
Open Row is developing artificial-intelligence and automated technology capabilities intended to improve agricultural information management, onboarding, search, categorization, discovery, matching, and communications.
Open Row does not currently represent that substantive grower, buyer, or confidential information is routinely submitted to third-party artificial-intelligence providers for processing. Before introducing third-party AI processing of substantive grower, buyer, or confidential information, Open Row intends to review provider terms, confidentiality protections, security provisions, retention practices, training and model-improvement rights, subprocessors, deletion practices, and other appropriate safeguards.
When AI or automated functionality is introduced, automated results may contain errors. Users should independently verify material agricultural or commercial information before relying on it. Automated output is not intended to constitute an appraisal, professional recommendation, crop inspection, certification, valuation, or guarantee.
12. Sale, Sharing, and Advertising
Open Row's current business model is not based on selling personal information, and Open Row does not receive monetary consideration in exchange for personal information submitted through grower, buyer, winery, or other industry onboarding.
California and other privacy laws may use the terms "sell" and "share" in specialized ways that can include certain disclosures for cross-context behavioral advertising. Open Row does not currently use Meta Pixel. If Open Row implements advertising or tracking technology that changes the legal characterization of our data practices, we will update this Privacy Policy and implement any notice, consent, or opt-out mechanism required by applicable law.
13. Data Retention
Open Row retains information for as long as reasonably necessary for the purposes for which it was collected or otherwise legitimately maintained, including to provide and improve the Services, maintain accurate agricultural and business relationship records, preserve legitimate historical continuity, respond to users, comply with legal requirements, resolve disputes, prevent fraud or misuse, maintain security, and enforce agreements.
Retention periods vary depending on the nature, sensitivity, purpose, and continuing relevance of the information. Season-specific crop or availability information may be marked inactive, archived, or removed from active discovery once Open Row reasonably determines that it is no longer current. Historical agricultural information may remain useful for agricultural, relationship-management, analytical, or recordkeeping purposes and may be retained where reasonably appropriate.
When information is no longer reasonably necessary, Open Row may delete, deidentify, or aggregate it, subject to legal, contractual, security, backup, and recordkeeping requirements.
14. Corrections, Updates, and Profile Withdrawal
Growers and other authorized representatives may request correction of inaccurate profile information, updates to agricultural information, or withdrawal of a profile or information from active Open Row discovery by contacting micah@openrowmarket.ag.
Open Row may take reasonable steps to verify the identity or authority of the person making a request before modifying information. Withdrawal from active discovery does not necessarily require immediate deletion of information contained in historical records, backups, legal files, security records, dispute files, archived records, or deidentified or aggregated datasets.
Depending on where you live and whether a particular privacy law applies to Open Row, you may have additional legal rights concerning personal information. Open Row will process qualifying requests as required by applicable law.
15. Security
Open Row seeks to maintain reasonable administrative, technical, and organizational safeguards appropriate to the nature of the information and the company's operations. No method of electronic transmission, storage, or information-security system is completely secure, and Open Row cannot guarantee absolute security.
Users should also take reasonable precautions when transmitting sensitive or confidential information electronically.
16. Business and Corporate Transactions
Open Row may disclose or transfer information as reasonably appropriate in connection with financing, investment, due diligence, merger, acquisition, reorganization, sale of assets, change of control, or a similar corporate transaction. Where appropriate, such information may be subject to confidentiality restrictions or other protections.
17. Children
Open Row is a business-to-business agricultural technology platform intended for adults and commercial industry participants. The Services are not directed to children under 18, and Open Row does not knowingly seek to collect personal information online from children under 13.
If Open Row becomes aware that it has collected personal information online from a child under 13 in circumstances where collection is not legally permitted, Open Row will take appropriate steps to delete or otherwise address that information.
18. United States Focus and International Visitors
Open Row's Services are currently directed primarily toward the United States agricultural industry. Open Row does not represent that its Services are specifically designed for compliance with the privacy laws of every foreign jurisdiction.
If Open Row materially expands its operations outside the United States or intentionally offers Services to individuals in jurisdictions with additional privacy requirements, Open Row may adopt additional disclosures, agreements, consent mechanisms, or practices.
19. Third-Party Websites and Services
Our website or communications may contain links to third-party websites, services, maps, applications, or resources. Open Row does not control the privacy, security, or data practices of independent third parties. Their collection and use of information are governed by their own privacy policies and terms. We encourage you to review those policies before providing information directly to a third party.
20. Changes to This Privacy Policy
Open Row may update this Privacy Policy as our Services, technology, vendors, data practices, or legal requirements evolve. When we update this Privacy Policy, we will revise the effective date shown at the top. If a change materially affects how we use or disclose information previously collected, we will provide additional notice where required by applicable law or where otherwise commercially appropriate.
